Please read this Terms and Conditions Agreement carefully. It governs the conditions of use of the Litharian Wines online service produced by Global Hawk Pty. Ltd ("Service Provider").
You can access this Agreement at any time from the bottom of any page of the Service. It is designed to be an enjoyable and informative experience for all, and therefore its users must abide by certain rules. Your use of the Service constitutes your consent to comply with these rules.
The Service Provider may modify the following rules from time to time. Continued use of the Service by you will constitute your acceptance of any changes or revisions to the Agreement.

You agree and acknowledge that your failure to follow the rules set forth in this Agreement may subject you to civil and criminal liability.
COPYRIGHT
The Service contains material that is owned by or licensed to the Service Provider (Global Hawk Pty. Ltd.). This material includes, but is not limited to, the design, layout, appearance and graphics. The use of any material on the Litharian Wines website obtained through automated or manual techniques including any form of scraping* or hacking is prohibited.
*'scraping' includes page, content, screen or web scraping amongst others, and is the process of extracting information from websites usually by converting unstructured website content (usually HTML) into structured data
You agree that you shall not upload or otherwise make available to the Service any material protected by copyright, trademark, or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right.
The burden of determining that any material is not protected rests with you. You agree and acknowledge that you shall be solely liable for any damages resulting from any infringement of copyrights, trademarks, or proprietary rights.
You hereby grant to the Service Provider a royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display any content posted to the Service, in whole or in part, worldwide and to incorporate it in other works in any form, media or technology now known or later developed.

The content of the pages of the Service is for your general information and use only. It is subject to change without notice.
The Service Provider does not provide any warranty or guarantee as to the accuracy, quality or completeness of the information and materials found on the Service for any particular purpose.

You further agree not to alter or tamper with any information or materials on, or associated with, the Service.
INDEMNIFICATION
You agree that the Service Provider is not responsible, and shall have no liability to you, with respect to any information or materials posted by others, including but not limited to, infringing, defamatory, offensive or illicit material.
You agree to indemnify the Service Provider and its affiliates, employees, agents and representatives, and to hold them harmless from any and all claims and liabilities (including legal fees) that may arise from your submissions, from your unauthorized use of material obtained through the Service, from your breach of this Agreement, or from any such acts arising through your use of the Service.
STANDARDS AND INTEGRITY
All wines sold on the Litharian Wines website meet all aspects of the Food Standards Australia, New Zealand Authority (Standard 4.5.1) and comply with the Label Integrity Program and Register of Protected Geographical Indications and Other Terms.
LEGAL DRINKING AGE
Anyone aged under 18 years old is prohibited by Australia's laws to buy alcohol in any form. If you are underage and are caught drinking in licensed premises or public areas without supervision, you may be issued a warning, fined on the spot, or referred to the court, at the discretion of the police officer on duty.
MARKETING AND PROMOTIONAL MATERIAL
All our customers receive informative as well as promotional mailers from our side to keep them updated on latest happenings at Litharian Wines. However, if you wish to opt out of our mailers, you will find a link to unsubscribe located in all of our emailers towards the footer.
